Acceptable Use Policy
1. Purpose
This Acceptable Use Policy ("AUP") establishes the standards and rules that govern how you may use the websites, platforms, tools, services, and digital properties owned or operated by Adstorm LLC ("Company," "we," "us," or "our"). This AUP is designed to protect the integrity of our Services, the interests of our users and clients, the rights of third parties, and the public interest.
This AUP is incorporated by reference into our Terms and Conditions and constitutes a binding part of the agreement between you and Adstorm LLC. By accessing or using any Service, you agree to comply with this AUP in full. Capitalized terms not defined here have the meanings given in our Terms and Conditions.
2. Scope
This AUP applies to:
- All users of any website, application, tool, or platform operated by Adstorm LLC;
- All clients engaged under Consulting Services agreements with Adstorm LLC;
- Any individual or entity that accesses, browses, downloads content from, submits information to, or otherwise interacts with any Service;
- Any third party acting on behalf of or in connection with a user or client, including contractors, employees, or agents; and
- All use of Adstorm LLC's services, content, tools, APIs, and infrastructure, regardless of the device, network, or medium through which access occurs.
This AUP applies globally. Users are responsible for ensuring their use of the Services complies with all applicable laws and regulations in their jurisdiction, in addition to this AUP.
3. Prohibited Activities - Illegal and Harmful Conduct
You may not use the Services in connection with any activity that is illegal, harmful, or unethical. The following activities are strictly prohibited:
3.1 Illegal Content and Activities
- Accessing, transmitting, storing, or distributing content that is illegal under any applicable law, including child sexual abuse material, content promoting terrorism, or materials that violate obscenity laws;
- Facilitating, promoting, or engaging in any form of human trafficking, forced labor, or exploitation;
- Engaging in activities that constitute money laundering, tax evasion, or financing of illegal activities;
- Using the Services to conduct, facilitate, or promote any criminal activity;
- Violating any applicable export control, sanctions, or trade embargo laws;
- Distributing, selling, or facilitating the sale of controlled substances, counterfeit goods, or other illegal products or services; and
- Engaging in any activity that violates the intellectual property, privacy, or other legal rights of any person or entity.
3.2 Fraud and Deception
- Engaging in any form of fraud, including click fraud, ad fraud, affiliate fraud, or conversion fraud;
- Using the Services to perpetrate or facilitate financial scams, pyramid schemes, Ponzi schemes, or fraudulent investment offerings;
- Misrepresenting your identity, affiliation, or credentials to Adstorm LLC, other users, or any third party;
- Creating fake reviews, testimonials, or social proof through automated means or coordinated inauthentic behavior;
- Using the Services to collect, store, or process payment card information in violation of the Payment Card Industry Data Security Standards (PCI-DSS); and
- Submitting false chargebacks or engaging in any other form of payment fraud.
3.3 Harassment and Harmful Content
- Harassing, threatening, intimidating, stalking, or abusing any individual through or in connection with the Services;
- Posting, transmitting, or distributing content that is defamatory, libelous, or constitutes harassment or hate speech;
- Engaging in targeted harassment campaigns or coordinating with others to harass specific individuals; and
- Using the Services in a manner intended to cause emotional distress or harm to any individual.
4. Prohibited Activities - Technical and Security Violations
4.1 Unauthorized Access and System Interference
- Attempting to gain unauthorized access to any part of the Services, other users' accounts, or any computer systems, networks, or databases connected to the Services;
- Circumventing or attempting to circumvent any authentication, access control, or security mechanism of the Services;
- Using the Services to conduct or facilitate attacks on third-party systems, including distributed denial of service (DDoS) attacks, port scanning, or network probing;
- Exploiting any security vulnerability in the Services, whether intentionally or by continuing to use a vulnerability after becoming aware of it (you must report vulnerabilities promptly to hello@adstorm.agency); and
- Using the Services through any automated method (bots, scrapers, crawlers) except as expressly authorized by Adstorm LLC in writing.
4.2 Malware and Harmful Code
- Uploading, transmitting, or distributing any viruses, worms, trojans, ransomware, spyware, adware, or any other malicious software or code;
- Introducing any software that disrupts, damages, or limits the functioning of any computer software, hardware, or telecommunications equipment;
- Deploying any code that creates unauthorized backdoors, intercepts data, or enables remote control of systems; and
- Using the Services to host, distribute, or serve malware to third parties.
4.3 Data Mining and Reverse Engineering
- Scraping, crawling, or using automated tools to extract data from the Services without prior written permission from Adstorm LLC;
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or underlying structure of any software or technology used in or associated with the Services;
- Accessing the Services via non-standard interfaces, including unauthorized APIs or browser automation tools; and
- Copying or replicating the structure, design, or functionality of the Services without authorization.
4.4 Infrastructure Abuse
- Placing an unreasonable or disproportionately large load on the Services' infrastructure or network bandwidth;
- Using the Services to generate or facilitate spam, bulk messaging campaigns, or unsolicited commercial communications in violation of applicable law and our Anti-Spam Policy;
- Impersonating the Services, mimicking our interfaces, or using our branding to conduct phishing attacks; and
- Using the Services as a proxy, VPN service, or anonymization tool for activities prohibited under this AUP.
5. Prohibited Activities - Intellectual Property and Privacy
5.1 Intellectual Property Infringement
- Copying, reproducing, distributing, publicly displaying, or creating derivative works from any Content owned by Adstorm LLC or its licensors without authorization;
- Using any trademark, service mark, trade name, or logo of Adstorm LLC or any third party without permission in a manner likely to cause confusion;
- Uploading, posting, or distributing content that infringes any copyright, patent, trademark, trade secret, or other intellectual property right of any party;
- Framing, mirroring, or otherwise incorporating any part of the Services into any other website or application without written consent; and
- Removing, altering, or obscuring any copyright notice, trademark, or proprietary rights notice appearing in or on the Services.
5.2 Privacy Violations
- Collecting, harvesting, or processing Personal Data of any individual through or in connection with the Services without a lawful basis for doing so;
- Using the Services to conduct surveillance on individuals without their knowledge and consent;
- Publishing or sharing private information about any person without their explicit consent, including home addresses, phone numbers, financial details, or medical information ("doxxing");
- Using the Services in violation of any applicable data protection or privacy law, including the GDPR, CCPA, or UAE Personal Data Protection Law; and
- Processing personal data obtained through the Services for purposes other than those for which it was collected.
6. Advertising Compliance Standards
Adstorm LLC operates in the paid advertising and digital marketing industry. Clients engaging our Consulting Services and users creating advertising content through or with the assistance of our Services must comply with the following standards.
6.1 Truth in Advertising
- All advertising content must be truthful, accurate, and not misleading. Claims must be substantiated with credible evidence before publication;
- Performance claims, earnings representations, income claims, health claims, and similar material claims must be accurate and reflect typical outcomes for the intended audience;
- Where claims reflect exceptional or atypical results, this must be clearly and conspicuously disclosed in close proximity to the claim;
- Advertising must not use deceptive formats or design techniques intended to mislead consumers (including but not limited to fake news articles, deceptive advertorials, or misleading before/after comparisons); and
- All pricing must be disclosed accurately, including all fees, taxes, and recurring charges, before a consumer completes a purchase.
6.2 Regulatory Compliance
Advertising created or facilitated through our Services must comply with applicable advertising regulations, including:
- FTC (United States): All advertising must comply with the Federal Trade Commission's guidelines on endorsements, testimonials, native advertising, and disclosures. Material connections between advertisers and endorsers must be clearly disclosed;
- ASA (United Kingdom): Advertising directed at UK audiences must comply with the UK Advertising Standards Authority's Advertising Codes, including the CAP and BCAP Codes;
- EU Directives: Advertising directed at EU audiences must comply with the EU Unfair Commercial Practices Directive, the Digital Services Act, and applicable national advertising standards;
- UAE Standards: Advertising directed at UAE audiences must comply with UAE Federal Law on Combating Commercial Fraud and applicable media regulations; and
- Platform Policies: All advertising must comply with the advertising policies of the relevant platform on which it is placed (including but not limited to Meta, Google, TikTok, and programmatic networks).
6.3 Prohibited Advertising Claims and Practices
- Making unsubstantiated or exaggerated health, weight loss, or medical claims;
- Making guaranteed income or "get rich quick" claims without appropriate and prominent disclosures;
- Using fake urgency, false scarcity, or countdown timers that reset to manufacture pressure;
- Running ads that use deceptive lander techniques, including fake news sites, fake government endorsements, or unauthorized celebrity endorsements;
- Targeting advertising to individuals known to be minors for products unsuitable for minors; and
- Using dark patterns in advertising funnels designed to trick consumers into purchases they did not intend to make.
6.4 Required Disclosures
The following disclosures must be clear, conspicuous, and in close proximity to the relevant claim:
- Material connections between brands and endorsers or affiliates (e.g., "#ad," "#sponsored," "Paid partnership with");
- Results disclosures for income, weight loss, or other performance claims (e.g., "Results are not typical. Individual results will vary.");
- Risk disclosures for financial products and investment-related advertising; and
- Subscription and recurring billing disclosures before checkout, including renewal terms and cancellation procedures.
7. Content Standards
Any content you submit, upload, post, or otherwise make available through the Services must meet the following standards:
- Content must not violate any applicable law or regulation;
- Content must not infringe the intellectual property rights of any third party;
- Content must not be defamatory, fraudulent, or materially misleading;
- Content must not contain or promote hate speech, discrimination, or violence against any individual or group on the basis of protected characteristics;
- Content must not contain sexually explicit material unless on a platform expressly designated and legally authorized for such content;
- Content must not endanger public health or safety; and
- Content must not be designed to harm, deceive, or exploit consumers, particularly vulnerable populations.
Adstorm LLC reserves the right to remove or refuse to publish any content that violates this AUP or that we determine, in our sole discretion, is otherwise objectionable, regardless of whether it meets all the specific criteria listed above.
8. Reporting Violations
Adstorm LLC encourages responsible reporting of suspected violations of this AUP. If you become aware of any use of the Services that appears to violate this AUP, you may report it to us at hello@adstorm.agency. When making a report, please include:
- Your contact information (name and email address);
- A description of the suspected violation;
- The URL, account, or other identifier associated with the alleged violation, where available;
- Any supporting evidence you have gathered; and
- Any other information that may assist us in investigating the report.
Adstorm LLC will review all reports in good faith and take appropriate action where a violation is substantiated. We may not be able to provide you with details about the outcome of an investigation due to confidentiality or legal constraints. Making a false or malicious report in bad faith may itself constitute a violation of this AUP.
9. Consequences of Violation
Adstorm LLC takes violations of this AUP seriously. Depending on the nature and severity of the violation, we may take the following actions:
- Warning: For minor or first-time violations, we may issue a written warning and require you to cease the non-compliant activity;
- Content Removal: We may remove or disable access to any content or materials that violate this AUP;
- Account Suspension: We may temporarily suspend your access to all or part of the Services pending investigation or remediation;
- Account Termination: For serious, repeated, or willful violations, we may permanently terminate your account and access to all Services;
- Termination of Consulting Agreement: Violations by clients may result in immediate termination of the relevant consulting or service agreement, with fees for completed work remaining due and payable;
- Legal Action: Where violations constitute illegal conduct or cause harm to Adstorm LLC, other users, or third parties, we may pursue civil or criminal remedies, including reporting violations to law enforcement authorities; and
- Financial Recovery: We may seek to recover damages, costs, and expenses caused by your violation of this AUP, including through indemnification claims under our Terms and Conditions.
We reserve the right to cooperate with law enforcement agencies in the investigation of any suspected illegal activity and to disclose information about users where we are legally required or permitted to do so.
10. Modifications
Adstorm LLC reserves the right to modify this AUP at any time. We will post the updated AUP on our website and update the "Last updated" date. Material changes will be communicated to active users and clients through the Services or by email where practicable. Your continued use of the Services after any modification constitutes your acceptance of the revised AUP. If you do not agree to the revised AUP, you must discontinue use of the Services.
We may also supplement this AUP with additional guidelines or policies applicable to specific Services or user categories. Any such supplemental policies are incorporated into this AUP and have the same binding effect.
